After 129 Projects Go Into CIRP, UP RERA Suspends Homebuyer Proceedings and Redirects All Claims to IRPs

The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has issued a detailed public advisory informing homebuyers that it can no longer entertain, hear, or enforce complaints relating to 129 real estate projects that have entered the Corporate Insolvency Resolution Process (CIRP) before the National Company Law Tribunal (NCLT) between January 2024 and December 2025. The authority clarified that with the initiation of insolvency proceedings against 14 real estate companies, jurisdiction over these projects now lies exclusively with the NCLT and the Insolvency Resolution Professionals (IRPs) appointed for each project.

UP RERA stated that this position flows automatically from the moratorium mandated under Section 14 of the Insolvency and Bankruptcy Code, which becomes operational immediately upon the admission of CIRP. During the moratorium period, all legal, regulatory, and recovery actions are suspended, preventing RERA from continuing pending hearings, executing earlier orders, or initiating new proceedings pertaining to the affected projects. The authority emphasised that until the conclusion of the moratorium, the rights and grievances of allottees must be addressed only before the concerned IRP in accordance with the IBC framework.

In its advisory, UP RERA urged homebuyers of these affected projects to promptly lodge their claims directly with the respective IRPs using the forms prescribed by the Insolvency and Bankruptcy Board of India (IBBI) and the NCLT, including Form CA and other relevant formats, ensuring timely recognition of their interests in the resolution process. The authority called on allottees to maintain continuous communication with the IRPs for updates on claim verification, status of the project, meetings of the Committee of Creditors (CoC) and further directions issued during CIRP.

 

The list of companies now under CIRP includes Ajnara Realtech Limited, Supertech Township Project Limited, Kindle Infra Heights Private Limited, BCC Infrastructures Private Limited, Morpheus Pro Developers Private Limited, Mist Direct Sales Private Limited, Rudra Buildwell Constructions Private Limited, ATS Heights Private Limited, Nobility Estates Private Limited, Vardhaman Infradevelopers Private Limited, Nikhil Homes Associates, Mahagun India Private Limited and Supertech Realtors Private Limited, each placed under separate IRPs. The authority recorded that Ansal Properties and Infrastructure Limited alone accounts for 97 projects now under CIRP, supervised by IRP Navneet Gupta.

UP RERA reiterated that homebuyers must rely exclusively on formal communication issued by the IRPs and the NCLT for future developments. It further appealed to allottees of the 129 affected projects to visit the UP RERA official web portal to identify the status of their project and to ensure that their claims are formally registered without delay, since this step is essential to safeguard their financial stake during the insolvency resolution process. The authority made it clear that no intervention from RERA will be possible until the moratorium is lifted and the CIRP concludes.
