Congress MLA Rahul Mamkootathil Seeks Anticipatory Bail In Rape And Miscarriage Case

Congress MLA from Palakkad constituency (Kerala), Rahul Mamkootathil on Friday approached the Sessions Court in Thiruvananthapuram seeking anticipatory bail in the rape case registered against him by the Nemom Police. Mamkootathil had been suspended from the Congress party in August this year after multiple women levelled allegations of sexual misconduct against him. He had also stepped down from his role as Youth Congress Chief following the controversy.
The present FIR was lodged after the complainant and her family met Chief Minister Pinarayi Vijayan at the Secretariat on November 27 and submitted a written complaint, prompting the police to register the case. The MLA has been booked under several provisions of the Bharatiya Nyaya Sanhita (BNS) relating to rape, causing miscarriage, and criminal breach of trust, in addition to offences under the Information Technology Act.
According to the survivor, Mamkootathil subjected her to sexual assault, impregnated her, and then coerced her into terminating the pregnancy. She has further alleged that he recorded intimate videos without her consent and later used them as threats. In his bail plea, Mamkootathil has maintained that the allegations are false and politically driven. He has claimed that the complaint surfaced only after he became a prominent opposition MLA and youth leader and that no such allegations existed previously. He acknowledges in the petition that he had a physical relationship with the complainant but submits that the relationship was consensual. The plea states: "Regarding the alleged offence, the offence U/s. 64 will not be attracted as the relation between the petitioner and the victim was consensual. The chats and phone call recordings between the parties will support this. The victim also admits that the relation was consensual which was the reason for her to visit the petitioner in multiple places."
He has also contended that the complainant is married to a BJP member and is living with him, asserting that this, along with her professional background in the media, indicates a political motive behind the accusation. Mamkootathil has further alleged that the case has been engineered by the Left government with the intention of diverting public attention from the ongoing Sabarimala gold theft controversy. Claiming that custodial interrogation is unnecessary, the MLA has sought anticipatory bail from the Sessions Court.
