IBBI Notifies Insolvency Resolution Process For Corporate Persons (Sixth Amendment) Regulations 2025

The Insolvency and Bankruptcy Board of India (IBBI) has notified the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) (Sixth Amendment) Regulations, 2025, through a notification dated October 14, 2025. The amendment has been issued by exercising the powers conferred under Section 196 read with Section 240 of the Insolvency and Bankruptcy Code, 2016 (IBC).
The newly notified amendment, which has prospective effect, modifies specific provisions of the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) Regulations, 2016.
Changes Introduced
The amendment omits Regulation 39C of the CIRP Regulations, 2016. Regulation 39C had earlier dealt with certain provisions related to the approval of the resolution plan and related procedural aspects, which now stand deleted.
In addition, clause (a) of Regulation 39D has been revised to insert the word “and” after the phrase “Companies Act, 2013;”.
Furthermore, the amendment omits clause (b) of Regulation 39D, thereby simplifying the language and structure of the provision.
The Sixth Amendment also deletes point (b) in Form H, which is the format prescribed for submitting compliance certificates by resolution professionals under Regulation 39(4).
