Kerala Court Grants Anticipatory Bail To MLA Rahul Mamkootathil In Second Rape Case

The District and Sessions Court, Thiruvananthapuram, on Wednesday (December 10) allowed the anticipatory bail application filed by Palakkad MLA Rahul Mamkootathil in connection with the second rape case registered against him. The case has been booked under Section 376 of the Indian Penal Code at the Crime Branch Police Station. According to the prosecution, the complainant is currently residing outside Kerala. The order was delivered by Principal District and Sessions Judge Smt. Nazeera S., and the detailed order is awiated.
As per the prosecution narrative, in 2023, Mamkootathil allegedly contacted the woman through the Telegram application after obtaining her phone number, assuring her that he intended to marry her. It is alleged that he subsequently persuaded her to meet him privately and took her to a premises resembling a homestay, claiming he wished to discuss their future. The allegation is that he assaulted and raped her there, despite clear resistance from her side. The prosecution further states that the complainant sent an email describing the incident to the Kerala Pradesh Congress Committee, which was then forwarded to the State Police Chief, ultimately resulting in the registration of the present FIR by the Crime Branch.
In his plea for anticipatory bail, Mamkootathil contended that there was an unexplained delay of two years before the complainant approached the authorities and that no formal complaint had been submitted earlier. He asserted that the accusations were unfounded and did not disclose the ingredients of any offence. His petition also pointed out that "the email doesn't give any information about the victim, or the information about the date of occurrence, place of occurrence and even no one has the idea whether the complainant is a girl or not."
The matter had been heard in detail on Monday, following which the court reserved orders for Wednesday. Notably, Mamkootathil’s earlier request for pre-arrest bail in a separate case involving allegations of rape and miscarriage had been rejected by the Sessions Court. That matter is now before the High Court, which is scheduled to consider his anticipatory bail plea on December 15 (Monday), and he continues to remain under interim protection from arrest in that case.
