
No Fresh Petition on Same Issue: Supreme Court Rejects PIL on Farmers' Protest

The Supreme Court today dismissed a public interest litigation (PIL) concerning the farmers' protests, highlighting that a related case on the same issue is already pending before the Court, with certain actions having been taken. Justices Surya Kant and Manmohan, presiding over the matter, allowed the petitioner’s counsel to assist in the pending case, provided the counsel wished to do so.
The PIL sought directions from the Union and Punjab governments to lift restrictions on farmers' protests and to prevent the blocking of National Highways and railway tracks. The bench noted that the same concerns had been raised in a pending case. The petitioner’s counsel argued that while the Court had taken steps to address the farmers’ grievances, the petition primarily highlighted the difficulties faced by commuters in affected areas.
Justice Kant responded firmly, stating, "We are aware of everything. It's not that he (petitioner) alone is the conscious-keeper of society and rest are not aware...don't file repeated petitions." The Court also cautioned against repeated petitions, emphasizing that such actions could create the impression of publicity-seeking litigation. The petitioner's counsel later requested to have the petition tagged with the ongoing case, but Justice Kant made it clear that no new petitions would be entertained on the same issue. However, the counsel was permitted to assist in the pending case if so advised.
