In a recent ruling, the Supreme Court of India underscored the critical importance of integrity and professionalism among High Court judges. The Court's remarks were part of a judgment that conveyed strong disapproval of a Gujarat High Court judge who released a detailed judgment nearly a year after pronouncing the operative order in court. This delay was criticized as undermining the values that the judiciary is expected to uphold.
The Supreme Court, through a bench comprising Justices Dipankar Datta and Prashant Kumar Mishra, emphasized that judges should adhere to high standards of conduct and integrity while discharging their judicial duties. The Court noted that unexplained and undue delays in releasing reasoned judgments could erode public trust in the judiciary and damage its reputation. This case has highlighted the judiciary’s ongoing struggle to balance workload demands with the necessity of swift and fair judicial determinations.
The bench specifically called upon High Court judges to strive to issue the reasoned portion of their judgments within a window of 2 to 5 days following the announcement of the operative order. Such a timeline, according to the Supreme Court, would ensure greater transparency, efficiency, and accountability within the judicial system. The Court’s remarks reflect a growing concern about recent deviations from expected judicial conduct, with certain instances attracting negative attention and impacting the judiciary's credibility.
Justice Datta and Justice Mishra took the opportunity to stress that any delay in issuing judgments without a valid justification is unacceptable, as it jeopardizes the judicial system's reputation for fairness and prompt justice. The bench also pointed out that the judgment's operative part, when pronounced in open court, has a binding effect on parties, and the reasoning behind the judgment should follow shortly to ensure clarity and understanding of the judicial mind.
This case, along with other similar incidents in recent times, has raised awareness regarding the responsibility of judges to maintain the integrity of their office. The Supreme Court's criticism serves as a reminder that the judiciary, as an institution, must not only be impartial and fair but also efficient and timely in delivering justice. The bench's observations have sparked discussions in legal circles, with many interpreting them as a call to reinforce the standards that have long been the cornerstone of India's judicial system.
The ruling comes at a time when judicial accountability is increasingly under scrutiny, and the need for transparency in the legal process is stronger than ever. The Supreme Court’s guidance, urging High Court judges to adhere to a recommended timeline for issuing reasoned judgments, is seen as a step towards reinforcing the judiciary's commitment to its foundational principles of justice, integrity, and probity.
In conclusion, the Supreme Court's recent observations underscore the expectation that High Court judges not only render fair judgments but do so in a timely and transparent manner, to uphold the dignity and reputation of the judiciary.
